VOSPOSTS is only bound by a best-efforts obligation concerning accessibility to the Site. 5. Responsibilities

As such, they guarantee VOSPOSTS against all claims based directly or indirectly on these texts, statements and/or data, which may be brought by anyone against VOSPOSTS. The User undertakes to cover the payment of any sums whatsoever resulting from a third-party claim against VOSPOSTS, including legal costs and lawyers' fees.

VOSPOSTS is not bound by any general obligation to monitor content posted online by Users. VOSPOSTS, in its capacity as host, will remove any manifestly unlawful content once it has actual knowledge of it, after prior notification in accordance with Article 6-I 5° of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy.

VOSPOSTS also reserves the right to delete all or part of the content and contributions of Users, at any time and for any reason whatsoever, without prior warning or justification. The User may not make any claim in this respect.

VOSPOSTS also reserves the right to administer advertisements, payments and agreements as it sees fit.

When using the Site, the User undertakes not to contravene the legislative and regulatory provisions in force and these Terms of Use. The User is informed that any breach of said provisions may result in legal proceedings and sanctions against them.

In general, the Site declines all responsibility in the event of use that does not comply with the Terms of Use and its services.

The User undertakes to act diligently to respond to any complaint. The User is responsible towards VOSPOSTS and/or third parties for any material and/or immaterial, direct and/or indirect damage of any kind caused by the User and/or their agents as a result of use of the Site that does not comply with these terms. The User guarantees VOSPOSTS, as well as its parent, sister or affiliated companies, its representatives, employees and partners, against any request, claim and/or action of any kind resulting from any breach of said provisions.

If the User wishes to propose a link to a website published by a third party, they may do so provided that this link opens a new browser window. To the extent that no control is exercised over these external data, VOSPOSTS assumes no responsibility for making the content of these third-party sites available, and the User undertakes not to propose any link that would infringe the legal provisions in force or these general conditions. VOSPOSTS reserves the right to request the removal of a link to a third-party site that it does not consider compliant with its policy or that contravenes the legal and regulatory provisions in force.

The invalidity, in whole or in part, of one or more provisions of these Terms of Use, pursuant to a legal or regulatory provision or a final court decision, shall not result in the invalidity of the other provisions or of the part of the provision not affected by invalidity.

If any part of the stipulations of these Terms of Use should prove to be illegal, invalid or unenforceable for any reason whatsoever, the term or terms in question shall be deemed non-existent, and the remaining terms shall retain their full force and scope and continue to apply. The terms declared non-existent shall be replaced by one or more terms that come as close as possible in content to the annulled clause.

 

 

10. Applicable law and jurisdiction

 

Use of the Site is governed by French law, to the exclusion of any other legislation.

Given the international dimension of the Internet network, VOSPOSTS reminds you that you must comply with all mandatory and public-order rules applicable in the country where you reside.

Any potential dispute relating notably to the application, performance, interpretation and/or validity of the Terms of Use and/or the Use of the Site and/or the services offered, which is not settled amicably, shall be brought exclusively before the competent Court of Paris.
